Procter & Gamble files a lawsuit in Canada against Concord, Ontario-based Apollo Health and Beauty Care for infringement of intellectual property related to its Herbal Essences brand. Apollo "is distributing look-alike Herbal Essences shampoo and conditioner products" that infringe P&G's trademark, trade dress and design "to capitalize on the brand's success and loyalty," the firm says Dec. 11. P&G asks for an order to stop the private labeler from distributing the products, recall existing inventory from stores and destroy the bottle molds.
