PBM Products filed a formal response to a law suit filed by Mead Johnson alleging trade dress infringement, false designation of origin and unfair competition related to the PBM-introduction of store-brand infant formula Member's Mark Infant Formula. The case, filed Jan. 4 in the U.S. District Court for Southern Indiana, contends Mead's Enfamil LIPIL product has suffered in sales due to similarity in packaging of Member's Mark. PBM denies all allegations. PBM CEO Paul B. Manning says the reason for Enfamil LIPIL's sales downturn is, "Moms and dads realize that, given the federal regulations that govern infant nutrition, price, and not brand, is what really matters when it comes to buying baby formula."
