Executive Summary

Imposes a 1 " per container fee on bottles, cans, jars and beverage containers from 5 ounce to 1 gallon in size and applies to cosmetics and cosmetic and toiletry products containing "medicine," including dandruff shampoo, sunscreen and mouthwash. The Florida Department of Environmental Protection (DEP) said it will publish an updated proposed rule outlining exemptions from the law in mid-September once it has reviewed comments on the proposed exemption rule currently circulating. Florida said the cosmetics and OTC items are unlikely to be exempted in the next rule. At a recent workshop on the proposed rule, both CTFA and NDMA argued for exemptions from the law for cosmetics and OTCs.
