Rite Aid suit against Medco
Executive Summary
Rite Aid wins Maine state court decision Sept. 18 that will allow the company's retail pharmacies to participate in the maintenance prescription portion of the Maine State Employees Paid Prescription Program. Medco Containment had been the exclusive contractor. The court ruled that the exclusive Medco contract violated the state's Third-Party Prescription Act, which requires that all state pharmacies be eligible to participate in third-party drug programs. Rite Aid says it will fill maintenance prescriptions "at no additional cost to the state or to its employees".
